We are Diamond Resorts Corporation, a for profit company registered in Maryland, USA, with FEIN 95-4582157 and registered office address at 6355 MetroWest Boulevard, Suite 180, Orlando FL 32835. We are a wholly owned subsidiary of Hilton Grand Vacations Inc, a Delaware corporation, with FEIN 81-2545345 and main office at 6355 MetroWest Blvd., Suite 180, Orlando, Florida 32835.

2. Agreeing to these terms
These are the terms and conditions that apply when you book accommodation on our website. By booking accommodation from our website, you enter into a contract with us on these terms.
3. Changes to these terms
We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a booking. The terms and conditions that apply to your booking will be those in place on the date that you make your booking.

BOOKING ACCOMODATION
5. How to make a booking
To book your accommodation please follow the instructions on the website.
You must be at least 18 years of age to make a booking. Those under 18 years of age are not permitted to stay at our resorts unless a parent or guardian is also staying at the campground. We reserve the right to request valid photographic proof of identity and age, so please bring this with you.
Please check that the details of your booking are complete and accurate before you confirm your booking.
If you think that there is a mistake in your booking or if you require any changes to a confirmed booking, please contact us using the details set out at the beginning of these terms. For more information on cancellation, please see section 13 below.
The contract between us for the provision of your accommodation will be formed once you have completed your booking online.
6. Confirmation of your booking
We will confirm your booking by sending you an email to the email address that you provided during the booking process.
7. Where our contract for your booking will be stored
The details of your booking will be stored on our systems.
PRICING AND PAYMENT
8. Pricing
We adopt dynamic pricing and the price of our accommodation fluctuates based on demand. When you make a booking request, we'll give you a total price for the accommodation and number of nights you've requested. The price you pay is the price quoted to you at the time you make your booking. The total price you pay online does not however include the additional mandatory charges that become payable at the resort, please see sections 10, 22 and 23 below for more information.
The price for the accommodation including taxes (stated at the applicable rate at the time of your booking) will be quoted to you at the time you make your booking. If the rate of tax changes between your order date and the date of your stay, we will adjust the rate of tax that you pay, unless you have already paid in full before the change in the rate of tax takes effect.
9. Additional charges
An Additional Persons Charge is mandatory and will become payable at the resort at check-in if the occupation for a campsite exceeds 2 (two) persons.
You will need to agree to these additional charges (by ticking the relevant tick box) when making your booking.
Additional charges may also become payable at the campsite, for example, if you choose to make use of on-site facilities and services.

10. When you must pay and how you must pay
Depending on which rate you book (see below) you will either pay in full at the time of booking or on arrival at the campground. Payment may be made by credit or debit card. Please check the campground homepage, on our website, to see which methods of payment are accepted.
Payment is taken in the currency where the campground is located. Please be aware that your bank may charge you a transaction fee.
For North American Destinations
Our rate plans include:

Book Now and Pay Later (pay on arrival): Full payment is due upon arrival at the resort.
11. Promotional offers
From time to time we may offer promotional discounts and offers. All promotions are subject to separate terms and conditions (including separate cancellation terms) which can be found on our website.
CANCELLATION POLICY
12. Your cancellation rights
We offer the following cancellation rights, which vary depending on the location of your resort and the rate plan you have chosen:
For North American Destinations

Book Now & Pay Later: Cancellations or modifications are permitted 72 hours prior to arrival. You must check-in before 10 p.m. (local campground time) on the day of your reservation. Arrivals after 10 p.m. will be subject to cancellation. Failure to check-in will result in a single night (plus tax) penalty being charged. Each reservation is for two (2) adults. There is a charge of $5 for each additional person. All Guests must stay in the one RV that is registered. A maximum of eight (8) Guests may stay under one reservation in the same RV.
Please contact the campground prior to arrival if you anticipate your arrival time would be later than 10 p.m. (campground local time). If you fail to check-in before midnight on your scheduled arrival date, you will be deemed to have cancelled your booking at that time and will be charged in accordance with the relevant rate plan as set out above.
You may wish to take out room cancellation insurance in case you need to cancel your booking.

14. How we will refund you
We will refund you as soon as possible and within 14 days of you notifying us you wish to cancel your booking (provided there are no delays caused by the processing of the refund by your card provider). We will refund you by the method you used for payment. We don’t charge a fee for the refund.
15. Our rights to cancel our booking with you
We may cancel your booking at any time with immediate effect by giving you written notice (which includes email) and, where relevant, claim any compensation due to us:

if you don’t pay us when you are required to do so;
-
if you don’t, within a reasonable time of us asking for it, provide us with information, cooperation or access that we need to provide the booking; or
-
where, due to events outside our reasonable control, we are unable to fulfil the booking (for reasons including industrial action, explosion, outbreak of disease, health and safety issues, fire, flooding, and failure of power and/or water supplies or emergency evacuation). In this case we will contact you to let you know as soon as possible and if the event cannot be resolved before your stay then:

if you have already paid for your room, we will refund your payment to you or, offer you alternative accommodation if there is availability; or
-
if you have not yet paid for your accommodation, you will not have to make any payment to us.
REQUIREMENTS FOR YOUR STAY

If you have any accessibility requirements or needs that you wish to discuss, please contact us as soon as possible using the contact details set out at section 1 of the terms.
17. Special Requests
Special requests for specific site locations and views cannot be guaranteed. The resort will try to accommodate your requests; however, they are based upon availability at the time of your site assignment at check-in.
18. Occupancy
Please refer to the relevant resort page, on our website, for more information regarding the maximum occupancy of your chosen accommodation.
All guests under 18 years old are included in the occupancy level for your accommodation. Under no circumstances may the maximum occupancy level be exceeded. Any additional guests must be registered at the resort reception in advance of arrival and may be subject to additional fees. You must provide details of all guests intending to occupy the accommodation at the time of booking.
19. Additional Campground Information
Please go to the front desk at The Suites at Fall Creek. Your vehicle may be left at the resort parking lot during check-in.
Pets must remain on a leash or in Guests’ personal vehicle/camper. Pets cannot be left unattended. No pets are allowed in the pool area, laundry, or shower house. Maximum of three (3) pets per reservation.
There is no tent camping at Fall Creek RV Campground.
Quiet hours are from 10:00 p.m. to 7:00 a.m.
There is no smoking permitted in the bathhouses, laundry, or pool areas. The campground has a no-littering policy.
20. Check-in & Check-out
Upon check in all guests over 18 years of age occupying the accommodation may be required to present a valid form of government issued photo identification along with the confirmation of your booking.
Check-in is after 2:00 p.m. and check-out is prior to 11:00 a.m.
21. Security Deposit
A refundable security deposit will be charged at the resort per unit of accommodation (unless otherwise noted in any relevant promotion offer description). The amount will be displayed to you during the booking process.
Security deposits will be taken at check-in, in the local currency of the resort, by debit or credit card (cash cannot be accepted).
Your security deposit will be refunded following an inspection of your accommodation at the end of your stay, provided there is no damage determined at our reasonable discretion. Please note the funds will only appear in your account once processed by your financial institution.
Please be reminded that guests who are unable to provide the security deposit will not gain entry to the accommodation.
22. Resort Fees, Taxes and Other Charges Payable By You
Additional charges will be taken at check-in, in the local currency of the resort, by debit or credit charge (cash cannot be accepted).
Please visit the campground homepage, on our website, for up-to-date information on the applicable resort fees, taxes and other mandatory charges payable by you at the resort.
23. Anti-Social Behavior Policy
Any anti-social behavior that affects the family friendly atmosphere of our resorts will not be tolerated. At its sole discretion, the resort reserves the right to refuse check-in or terminate the stay of any guest(s) displaying abusive or disruptive behavior that could cause harm to other guests or resort staff, including damage to the resort or affecting the enjoyment of other guests.
Due to the nature of our resorts, please note that they are not suitable for bachelor, bachelorette, stag, hen or similar parties. No illegal activity of any kind will be tolerated and will result in the party being ejected from the resort.
OUR RESPONSIBILITY FOR ANY LOSSES
24. Our responsibility for loss or damage suffered by you
We're responsible for losses you suffer caused by us breaking this contract unless the loss is:

Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).

Caused by a delaying event outside our control. As long as we have taken the steps set out in section 16(c) we're not responsible for delays outside our control.

Avoidable. Something you could have avoided by taking reasonable action.

A business loss. We are not liable for business loss. If you make a booking for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
25. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for

death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;

for fraud or fraudulent misrepresentation; or
-
for breach of your legal rights in relation to the booking including the right to receive services which are supplied with reasonable skill and care.
RESOLVING DISPUTES WITH US
26. You have several options for resolving disputes with us:

Complaints: Please contact us using the contact details set out in section 1 of these terms. Our Customer Service Teams will do their best to resolve any problems you have with us or your booking.

You can go to court: These terms are governed by the laws of Florida and wherever you live you can bring claims against us in the courts of Florida, Orange County, United States of America. We can also claim against you in the courts of the country you live in.

Local laws still apply: As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms, including this clause, affects your rights as a consumer to rely on such mandatory provisions of local law.
OTHER IMPORTANT TERMS APPLY TO OUR CONTRACT

How we use any personal data. How we use the personal data you give us is set out in our Privacy & Cookies Notice.

We can transfer our contract with you, so that a different organization is responsible for supplying the booking. We'll tell you in writing if this happens and we'll ensure that the transfer won't affect your rights under the contract.

You can only transfer your contract with us to someone else if we agree to this.

Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
